Each Pennyworth user, bidder, and consignor is governed by a tailored set of legally binding agreements. The documents below operate together to define your relationship with Pennyworth — from account creation through bidding, pickup, consignment, and the protection of your personal information.
Platform Sign-Up Terms & Conditions
Governs all access to the Pennyworth platform — account registration, user conduct, account suspension, reinstatement, intellectual property, electronic communications, mandatory arbitration, and data privacy.
Applies to: Every user who creates an account on the Pennyworth platform.
Auction Terms & Conditions
Governs participation in Pennyworth auctions — bidding, Buy Now purchases, payment, pickup, returns, premises liability, the Item Rating System, default consequences, and the account reinstatement fee.
Applies to: Every bidder, buyer, and visitor to Pennyworth premises.
Consignor Agreement
Governs the consignor relationship with Pennyworth — title and authority warranties, commission structure, settlement timing, unsold lot disposition, chargeback clawback, and indemnification.
Applies to: Every consignor who delivers property to Pennyworth for sale.
Privacy Policy
Describes how Pennyworth collects, uses, shares, and protects your personal information — including identity verification, payment data, communications, cookies, California and Texas privacy rights, and data retention.
Applies to: Every visitor, user, bidder, and consignor — anyone whose personal information Pennyworth handles.
How These Documents Relate
The four documents are designed to work together as a single coordinated framework. The Platform Sign-Up Terms and Conditions govern your initial relationship with Pennyworth at the moment of account creation. The Auction Terms and Conditions attach automatically when you register for an individual Pennyworth auction and are reviewed and accepted at the time of registration on each auction. The Consignor Agreement governs you separately if you choose to consign property for sale, and is accepted electronically at the Pennyworth Consign portal. The Privacy Policy applies to all of the above.
Each document is independently versioned, separately incorporated by reference where applicable, and subject to a unified arbitration framework administered by the American Arbitration Association in Hays County, Texas.
